UN ICJ Ruling on Ukraine's First Lawsuit versus Russia Possible in about Half a Year – Sources

Friday, 9 June 2023

A decision on the first of two lawsuits by Ukraine versus Russia at the UN International Court of Justice may take approximately half a year after the hearings are completed.

According to sources familiar with the procedures at the International Court of Justice (ICJ), it may take approximately six months after the conclusion of the hearings to reach a decision on Ukraine's first lawsuit against Russia.

The sources revealed to "European Pravda" that in most cases, the court tends to deliver a decision on the merits of the case around six months after the hearing stage.

The hearings for Ukraine's first lawsuit versus Russia, which accuses Russia of violating two UN conventions, began on June 6 and will finish on June 14. Consequently, the potential decision could be reached by the end of 2023 or early 2024.

The Ukrainian delegation refrained from making predictions regarding the timeline of the decision but recalled that the jurisdiction hearings, in this case, took place around the same dates in June, and the decision was delivered in November.

The case is titled "Application of the International Convention for the Suppression of the Financing of Terrorism and of the International Convention on the Elimination of All Forms of Racial Discrimination (Ukraine v. Russian Federation)." Ukraine filed this lawsuit in 2017.

Ukraine argues that Russia violated the relevant conventions by arming groups in its puppet "republics" in the occupied territories of Donetsk and Luhansk regions, as well as through its policies towards non-Russian ethnic groups in occupied Crimea.

On January 16, 2017, a representative of Ukraine filed a lawsuit for violating the first convention by arming groups of its puppet "republics" in the occupied territories of Donetsk and Luhansk regions and violating the second convention through its policies towards non-Russian ethnic groups in occupied Crimea.

In April 2017, the UN International Court of Justice issued an interim order against the Russian Federation to allow Crimean Tatar Mejlis' activities and ensure accessibility to education in the Ukrainian language.

In November 2019, the Court rejected all of Russia's arguments regarding the Court's jurisdiction and the admissibility of the case, which was a complete victory for Ukraine at that stage of the proceedings.
